The Health Inspectorate informs entrepreneurs on changes in submission of information regarding cosmetic products

In 21 May 2011 amendments[1]  to Regulations No 354 of the Cabinet of Ministers of the Republic of Latvia came into force cancelling the requirement for distributors of the cosmetic products to submit to the Inspectorate information on the composition of the cosmetic products for purposes of medical treatment.
Henceforth submitting to the Inspectorate information on the cosmetic products offered on the market in the Republic of Latvia, distributors shall not be obliged to add qualitative and quantitative composition of each cosmetic product to the notification form according to Annex 13 of the Regulations (form “Annex 13”[2]).
When filling in the form on the distributed cosmetic products, please leave Column 9 “Qualitative and quantitative composition (No of the annex)” blank.
Please note that the amendments do not refer to producers in Latvia and first importers in Latvia, which are still obliged to submit the composition of the cosmetic products for purposes of medical treatment.
Henceforth the information on cosmetic products can be submitted also by entities registered in another Member State of the European Union delivering products directly to a distributor in Latvia. Notification form according to Annex 12 of the Regulations (form “Annex 12”[3] ) is amended accordingly. Both forms are available also in English on the website of the Inspectorate.
 
The amendments also define more accurately requirements regarding the use of substances classified as carcinogenic, mutagenic and toxic for reproduction in the cosmetic products in accordance with requirements of the Community legislation, since in 1 December 2010 Paragraph 1 and 2 of Article 15 of Regulation (EC) No 1223/2009 of the European Parliament and of the Council of 30 November 2009 on cosmetic products came into force.
